These Terms and Conditions ("Terms") govern your access to and use of the Nexafora website at nexafora.com and the AI Readiness Platform at assessment.nexafora.com (collectively, the "Services"), operated by Nexafora LLC ("Nexafora," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
Nexafora operates Nexafora — The Organizational Intelligence Standard, a proprietary diagnostic system that determines organizational readiness for AI execution across structural dimensions. The Services include:
Access to the assessment platform requires a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.
You must be at least 18 years old and authorized to act on behalf of any organization whose information you input into the platform.
Paid Services are billed at the time of purchase through our payment processor, Stripe. All prices are in US dollars. Payments are non-refundable except as described in Section 4.
By completing a purchase, you authorize Nexafora to charge your payment method for the amount displayed at checkout. You represent that you are authorized to use the payment method provided.
Given the nature of digital diagnostic products delivered instantly upon payment, all sales are generally final. However, we will consider refund requests on a case-by-case basis in the following circumstances:

All content, methodology, scoring frameworks, question sets, report templates, and proprietary algorithms that constitute the Nexafora platform are the exclusive intellectual property of Nexafora LLC. This includes but is not limited to the 10-pillar readiness framework, the weighted scoring engine, and all AI-generated report content.
Your assessment results and AI-generated reports are provided for your internal business use only. You may not reproduce, distribute, resell, or create derivative works from Nexafora's proprietary methodologies or deliverables without express written authorization.
The Nexafora AI Readiness Index and associated reports are diagnostic tools intended to inform decision-making. They do not constitute legal, financial, investment, or technical advice. Results are based on information you provide and are generated by AI models — they should be reviewed by qualified professionals before making material business decisions.
Nexafora does not warrant that assessment results are error-free, complete, or suitable for any specific purpose beyond general organizational awareness.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described therein.
To the maximum extent permitted by applicable law, Nexafora shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to business decisions made based on assessment results.
Nexafora's total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the specific Service giving rise to the claim in the twelve months preceding the claim.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Nexafora does not warrant that the Services will be uninterrupted, error-free, or that results will meet your specific requirements.
Nexafora reserves the right to modify, suspend, or discontinue any aspect of the Services at any time. We may also update these Terms periodically. Material changes will be communicated by updating the effective date. Continued use of the Services after changes constitutes acceptance.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts located in Florida.
